App Terms of Use

Effective Date: January 1, 2026

These App Terms of Use ("App Terms") govern your use of the Regener8MD mobile app (the "App") and your purchase of Regener8MD test kits. They are part of our Terms of Use. By downloading or using the App, you agree to these App Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the App. You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity under your account.

2. The App Is a Wellness Tool, Not Medical Care

The free App, the Baseline Kit, and the Longevity Kit are wellness and education tools. Biological age estimates, scores, daily plans, and protocols in the App are informational and are not a diagnosis, treatment, or medical advice. No physician reviews your individual protocol at those steps, and using them does not create a physician-patient relationship with Regener8MD or Dr. Anthony Capasso.

A physician-patient relationship begins only when you enroll in Clinical Membership or Physician Concierge, after intake and signed consent. Always consult a qualified healthcare professional before starting, stopping, or changing any medication, supplement, diet, or exercise program. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

3. Test Kits and Lab Results

The Healthspan Assessment Panel is performed by Vibrant America, a CLIA-certified laboratory, under a clinician order from our practice so the laboratory can accept your sample. That order is a wellness-testing service, not a medical evaluation. Other at-home tests are performed by our testing partners. Results are delivered in the App as the laboratory reports them, and acting on them is your responsibility until you enroll in a physician membership.

If a laboratory flags a value as critical, we will relay that flag to you as soon as it reaches us, using the contact details on your order, and you agree to seek care from your own physician or emergency services without delay.

4. Purchases, Memberships, and Refunds

Prices are shown at the time of purchase. The Baseline Kit is refundable in full until your blood sample is collected, and the Longevity Kit until you activate the first kit; both are non-refundable after that. Blood draw fees are paid directly to the draw site or mobile phlebotomist you choose. Clinical Membership and Physician Concierge are billed and cancelled as described on our pricing page and in your membership agreement. Memberships are not health insurance.

5. Connected Devices and Third-Party Services

You may connect Apple Health or supported wearables. Data from those services is provided by them, may contain errors, and is used only as you authorize. Third-party services are governed by their own terms, and Regener8MD is not responsible for their availability or accuracy.

6. Your Data

Your results and the information you upload belong to you. You grant Regener8MD permission to use them to provide and improve the App and our services, as described in our Privacy Policy and Consumer Health & Genetic Data Notice. We do not sell your data.

7. Acceptable Use

You agree not to misuse the App, including by accessing another person's account, uploading content you do not have the right to share, interfering with the App's security or operation, reverse engineering the App except as permitted by law, or using the App for any unlawful purpose.

8. License and Intellectual Property

Regener8MD grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use. The App and all related content, design, and software are owned by Regener8MD and protected by intellectual property laws.

9. Apple App Store

If you downloaded the App from the Apple App Store, these App Terms are between you and Regener8MD only, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these App Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties. Your use of the App must also comply with the Apple Media Services Terms and Conditions.

10. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available." To the fullest extent permitted by law, Regener8MD disclaims all warranties, express or implied, and Regener8MD, its physicians, staff, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App. Individual results vary and are not guaranteed.

11. Suspension and Termination

You may stop using the App and delete your account at any time. We may suspend or end access to the App if you violate these App Terms or if needed to protect the App, other users, or Regener8MD.

12. Governing Law and Changes

These App Terms are governed by the laws of the State of Florida. We may update these App Terms; when we do, we will post the updated App Terms on this page and notify App users of material changes in the App. Continued use after changes take effect means you accept the updated App Terms.
